Chicago employment lawsuit
If you are considering pursuing Chicago employment litigation based on discrimination or harassment, you need to first file a complaint with either the Equal Employment Opportunity Commission (EEOC) or the Illinois Department of Human Rights (IDHR). You have 180 days to file your claim before the IDHR or 300 days to file your claim with the EEOC after an incident of discrimination or sexual harassment. After you file your claim, the IDHR or EEOC investigates and allows you to pursue litigation:
- If the EEOC finds substantial evidence of a legal violation but does not sue, it closes the case and sends a notice of your right to file suit in court within 90 days.
- If the EEOC does not find substantial evidence, it closes the case and still sends you a notice of your right to sue within 90 days.
If you choose to file a claim at the state level with the IDHR, it will often be automatically cross filed with the EEOC so that you retain your right to continue in federal court. We can prepare your charge before the IDHR and represent you before that agency. You can pursue a lawsuit in state or federal court even if the IDHR does not find there is enough evidence to prove your case. If the IDHR finds in your favor, you can pursue a case in the Human Rights Commission.
